I didn't write the laws so I can't tell you what the writers had in mind, but an obvious distinction is that bioweapons are even more indiscriminate than nukes.

You could conceivably have situations where you can use a nuke with a reasonable assurance that you aren't going to wipe out thousands of civilians - i.e. launching it at a remote military base or at a fleet of ships.

Once you get someone sick with your bioweapon it's completely out of your hands. It can spread to the civilian population of any nation.

Also, once an enemy surrenders you can at least stop launching nukes at them. If you've sent bioweapons in and the enemy surrenders, you can stop launching bioweapons, but the ones you've already launched can keep on killing unrestrained. A nuke is a single event, a bioweapon is a series of events that continues indefinitely.
