Hey /k/,

I bought this H&R .32 at an antiques shop as a "deactivated prop". It has a filled barrel, slag in the cylinders and the internals are loose.

In California, can I legally reactivate and shoot this? I'm 21 and can own a handgun.

the gun itself does not violate any laws of California, while there IS a registry, which is required, it's only required if you purchased a pistol. You purchased a paperweight, so it's not violating any laws to repair it to functionality, think of it like an 80% lower receiver.

A firearm is still legally a firearm until the receiver has been torched into three separate pieces. That is a firearm, and since it's old as fuck you have plausible deniability for being unregistered because you could have inherited it. Open up the frame and show us what you got. Worst case scenario you buy a donor gun off gunbroker, have an FFL repair it with the donor gun, and destroy or sell the old frame.

Technically, I think reactivating it would be considered manufacturing. So, technically, you would need to notify DOJ/fill out a truckload of paperwork if you were to do this thing.

So. Thing to do is buy a foreclosed storage unit at auction. A small, cheap one so you don't have a lot of extraneous bullshit to get rid of. Claim you found the gat in the stuff, register it with DOJ using the auction documentation as proof. That way, you can legalize the gun without running into any problems that may crop up due to you being an unlicensed gun maker.

Or, you could just reactivate it and keep it handy as a throw away gun. Iirc, it's only a misdemeanor if you're caught with an unregistered handgun.

There's something like 8 million registered gun owners in California. DOJ estimates that there's another 2-4 million gun owners who aren't in the system. You could become one of them.

It was never deactivated. The rest is totally irrelevant. Slagging the bore and plugging the cylinders does not deactivate the firearm.

Its only a misdemeanor if you're caught illegally CC-ing a registered handgun without a permit. Many people in CA have unregistered firearms. California law does not require registration of firearms you owned before registration began. Having an unregistered firearm is not illegal unless the firearm can be classified as an assault weapon or an NFA item. Long guns have only been registered at the point of sale or transfer since 2014 and handguns have been since 1991, but again if you owned these guns prior to these dates you are not required to register them. I am a CA resident and I wasn't old enough to own pistols prior to 1991 so all my handguns are registered however most of my long guns were purchased prior to 2014 so a majority of my long guns are unregistered and I've never had a problem. Even when my home was invaded in 2014 and I had to use my unregistered 870 in self defense the cops did ask if it was registered and I told them no but explained why and all they did was run the serial to see if it was stolen and do a quick records check on me to make sure I wasn't prohibited from owning guns after interviewing me about the incident which was very clear cut they didn't even take my gun although I think it mostly had to do with the fact that no one was killed.
