I guess I'll have to make a clearer distinction.

Case A: People under the age of 21 are prohibited from buying alcohol. Anyone above the age of 21 may purchase alcohol at the discretion of the vendor.

Case B: Individuals must petition the state for permission each time they wish to purchase alcohol.

Naturally the state, as states are wont to do, retains power in both circumstances but there is a clear limit based on the rule of law in the first example - therefore a reasonable person may expect not to be denied the sale of alcohol provided he meets the clearly defined requirements known beforehand. The second example is obviously different and represents a clear breakdown in rule of law - a person can not know with any degree of certainty if he will be allowed purchase of alcohol because each purchase must be preceded by supplication and each time it may be denied without process or recourse. Fall out of favor with the local commisar? Good luck buddy!

Except you are wrong. While the process is lengthy and in many ways arbitrary, should you complete it you have a reasonable assumption that your purchase will not be denied. Additionally, you do have recourse in multiple ways. They cannot deny you without proper cause and you have the right to know what it is.
