Is it true I can carry a black powder firearms concealed in Texas?
Next summer I might move there from California but I won't be able to get a regular CHl because I'm not 21 yet.
>What should I carry if it's true
>Inb4 stay in your containment zone
>>
1849 Pocket .31
>>
>>32227336
i seriously doubt it. whatever anyone else tells you, black powder firearms are usually considered firearms in all manners except in purchase.

that being said, you should check the laws yourself and not trust your freedom to a Vietnamese tax evasion forum
>>
>>32227418
It seems like it's true from everywhere I've checked.
I'm more curious about whether or not anons on here currently cc a black powder gun.
I'd also rather risk getting busted in Texas and resolving it in court than carry here and get ass raped by a court if I ever had to use my firearm.

I read someone's story in my state of him carrying a black powder revolver when he was 19, while saving for their carry permit. He got caught and charged with possession without a carry license. On a plus side, the judge was very easy on him but he still got fucked.
Wouldn't advise it OP

what is that glorious BP pistol?! i must obtain!
>>
>>32227544
aw shit i ment the one in op not the 1849 Pocket .31
>>
>>32227549
It's brass framed 1851 with the barrel cut down.
You can get an 1851 for $200 on cabelas and do it yourself.
>>
Is a BP firearm reliable? I know a water tight seal is suppose to be made by the lead, but I'd still be a little weary.
>>
>>32227336
I was working there last year i was asking around to conceal carry any gun you have to have your permit.
>>
>>32227502
>anons on here currently cc a black powder gun
that is retarded
> a water tight seal is suppose to be made by the lead
it doesn't
>>
>>32227336
Black powder firearms are not regulated by the state; however, there may be local ordinances. Check out PENAL CODE TITLE 10. OFFENSES AGAINST PUBLIC HEALTH, SAFETY, AND MORALS CHAPTER 46. WEAPONS.

Also check out "Armed and Educated" by Texas Law ShieldTexas and U.S. Law Shield’s series of Armed And Educated books are state-specific legal references — written in plain and understandable English — that contain critical information every gun owner should know:
>>
>>32227336

Note the operative fucking word: blackpowder FIREARM.

BP is only "not a firearm" for the purposes of needing a 4473 and FFL involved to buy one new.

It still fits the legal definition of a firearm for all other purposes, like jailing your ass for carrying without your permission slip.
>>
air rifles can be considered 'firearms' depending on your state and local laws. So I'm betting that a blackpowder pistol could as well.
>>
>>32227748

would sprinkling grains of rice into the black powder and mixing it in help keep the powder dry? would it do anything adverse if the powder containing rice was fired in a BP revolver?
>>
>>32227832
this anons right, most states have bits about deadly/lethal weapons as part of the law which a BP gun would qualify
>>
>>32227602
yes very reliable. unless you plan on leaving it underwater for a while you will be fine. you can even coat the outsides of the caps aroudn the nipples with something like wax
>>
>>32227832
>>32227832
this. if you look at the definition of firearm most states define it as an object which expends a projectile by force of combustion or flame etc. i dont know about texas specifically but i doubt a loaded and capped BP revolver would be legal to ccw without the required papers. maybe it is though, ask a lawyer there or go to some texas gun forum

If it's an antique or an antique replica, the rules are very loose. Read the book for a more comprehensive explanation. .... hope this helps

In the Texas penal code any black powder replica of a firearm designed before 1899 is not considered a firearm.

>>32227336
I used to CC an 1851 Navy in Texas before I joined the National Guard and got my permit legally at 19

Now I carry a Glock
>>
>>32228139
>>32228154
The original open carry ban in Texas was for black powder firearms after the civil war.

People tried to interpret the black powder firearms are not firearms for hunting laws and would wear revolvers to protests and get arrested.

Its a whole fucking mess of people thinking they know more of the law then they do and its also about intent.

Long story short, if you can't get a CCL don't carry open or not in Texas.
>>
>>32227602
I wouldn't count on that. Just smear some KY/animal fat in every cylinder mouth
>>
>>32228202 (You)
Found it

Chapter 46.01 Definitions.

3) "Firearm" means any device designed, made, or adapted to expel a projectile through a barrel by using the energy generated by an explosion or burning substance or any device readily convertible to that use. Firearm does not include a firearm that may have, as an integral part, a folding knife blade or other characteristics of weapons made illegal by this chapter and that is:

>(A) an antique or curio firearm manufactured before 1899; or

>(B) a replica of an antique or curio firearm manufactured before 1899, but only if the replica does not use rim fire or center fire ammunition.
>>
>>32228231
Those "Armed and Educated" folks are up to speed on the law. They are the ones who go around challenging state and local (mis)interpretation of firearm laws. I've contributed enough.
>>
>>32228202
Holy shit this is a kool pic fuckin saved.

>>
>>32228202

>>
>>32227336
Dude, you can carry a fucking assault rifle out in the open in Texas. I'm pretty sure you can carry whatever tf you want.
>>
>>32227336
Even though antiques and black powder guns aren't classified as firearms, in most places they are legally considered one if loaded.
>>
>>32228202
So um, is that a custom kydex shell? Where can I get one, maybe for a walker so I can CC .45 black prefer magnum for shits n giggles
>>
>>32229269
>>32228202
Disregard, upon further inspection I see it is for a Smith and Wesson or some other revolver and the navy just fits.
>>
>>32227832
BP guns are never transferable tard. The ATF regulates what a firearm is not your state...
