SBR requirements are barrel less than 16 inches or less than 26 overall lengths
So I wondered if I get a pps-43 If I got a 16 inch barrel without the stock the overall length would be 29.5 inches without the stock but would a folding stock count tward the length or would I have to get a Polish wooden stock
so it would be considered a rifle not SBR right?
Correct me if im wrong or clueless

if its got a stock on it and a sub 16 inch barrel its a sbr regardless of overall length
Barrel MUST be 16" minimum to not be an SBR

Yes the folding stock would count that's why it is welded to the gun

What about a PPS-43 "pistol" with a "brace"?

What I believe OP wants to do is replace the short barrel with a 16" one and get a working folding stock. Which he or she could do legally with no stamp required.

he could legally turn a pistol into a rifle with 29.5 overall in every state except California. since ca has its own minimum length for semiauto rifles think its 30 overall not sure google your own states shit laws.

No. It is welded to the gun because if it wasn't welded, it would be an SBR instead of a pistol.

Federally, overall length is measured with a folding or collapsible stock in the extended position. So, yes, you could install a 16" barrel, then cut the weld on the stock and have a legal rifle with a folding stock. Don't know if your local laws are more restrictive.

Folding stocks are measured with the stock deployed or with an adjustable stock fully extended.
