Can someone explain this to me? I've read a bunch of stories about how police will confiscate someone's weapon after they use it in a self defense scenario. Is this only done when foul play is suspected? Are there certain parameters that police have to see before legally taking a pistol?

I'm sure that this may be location dependent to some degree, but I'm really just looking for any information on this.

i've never been in a scenario where my firearms could have been taken, but from what i hear they take them to "verify they're not stolen" or some bullshit. Thats fairly common from what i've gathered. The part were your mileage may vary is upon return of your firearm. Some people have gotten their firearm back in perfect condition and others have had theirs returned missing optics, blemished, or disassembled.

I used my handgun to protect a woman in a parking lot I thought was getting robbed. I just heard the scream and ran over, turned out she was having an argument with her ex boyfriend, he fled when I pulled my steel on him.

I waited for the police, they took my ID and information, by the time they got there, I had moved my car and left my gun under the seat. They told me they had to make a copy of my CC ID and thats when they patted me down and then put my firearm in a brown paper bag.

I didn't get that handgun back for 2 and a half months.

Generally they take it for evidence in the even a court case comes from the incident.

Depending on how shitty your state is, they could also be running various tests to see if it matches any crimes (despite forensic ballistics being the legal equivalent of Voodoo).

It's shitty, but it's understandable to take it, especially if someone actually gets shot. Where it becomes unacceptable, however, is when it's somehow damaged while in police hands.

The gun was never discharged and I'd like to keep my pistol in firing order, thank you. The nig nog that ran was never found anyways, and I got my hi-point back without a firing pin and a missing rear sight, which I mean that is better than factory new but my point still stands.

No. Most agencies send a few guys to get armorer certified for the weapon they carry and thats about it. Also 99% of agencies aren't big enough to have a sophisticated and expensive enough ballistics unit of their CSI team. That shit gets sent to state labs for NIBN testing and can take months before it gets tested. The only "inspecting" a dept does to a firearm is within the scope of their documentation of the investigation. Make, model, caliber, S/N. We don't have time or even care you tubed someone with a 3.5 lb trigger connector in your Glock. Get over yourself. Most cops don't know fuck all about guns or gun laws anyway.

Sucks. I was in a shoot a little while back and they took everything except my boxer shorts. Hopefully I'll get my TLR1 back but it was issued so if not I can't be too mad. My belt and duty belt and flashlight were personally bought though so we'll see if I get it back.

I know a guy who got all of his guns taken (not for a shooting, it was over a domestic dispute). Anyway he was cleared of wrong doing and it took almost a year of fighting to get his guns back. The police used some sort of white paint to write on them and they were beat up as if they were just thrown in a pile in the evidence room. When I get a chance I will upload a pic of my sig p232 that the cops engraved after it went into evidence. Got it back with scribble on the barrel, the magazine and my damn flashlight too
