Nitori is a shy kappa by nature, and if she is alone and sees a human, she'll run away, like in Mountain of Faith. She considers herself to be superior to humans and even other youkai, and when she's by herself it's easy to see. However, when among her own circle of friends, she is quite cheerful. As a kappa, she is easily persuaded to leave you alone by a cucumber or two. However, she has a greedy side when it comes to running a stand and is quick to come up with plots to maximize profit.

Nitori is a jerk, but she's still shy. And cautious. She only screws with people if she knows them well enough to think she can get away with it.

In MoF she wasn't too familiar with humans, and was wary about making enemies of Reimu and Marisa. So instead she tried to butter them up (poorly) and get them to fight Moriya Shrine for her. When Reimu gets distracted, Nitori says that humans are worthless and she should have just asked the tengu instead.
At the time, most of the fanbase thought Nitori was just shy, but the jerkishness behind her actions is a lot easier to see in retrospect. Someone from Tasofro even commented to this effect in an interview on HM.

In SA she's constantly getting Marisa into fights and calling her an idiot. Then when she realizes Yuugi can hear her, she starts falling over herself trying to be polite and suck up to her (because Yuugi is a scary ex-boss who could theoretically come out of retirement at any time).

They're never really seen without their hats on, so you wouldn't be able to tell what's under them anyway.
Their backpacks are clearly meant to evoke the image of a shell on their backs, and could easily be used to conceal them. Alternatively, they could be explained as what the kappa have always had, and humans just interpreted them as shells.
As for the beaks and webbed digits, no other 2hu besides Waggysaggy go quite that far in terms of non-human features beyond their ears or the presence of wings, so it's silly to single the kappa out for lacking them.

See, I could understand people being upset that she acts like one of the kappa from "Kappa" by Ryuunosuke Akutagawa, and acts candid with her friends.

Except that 'Ryuunosuke Akutagawa's "Kappa" ~ Candid Friend' are THE FIRST WORDS ON THE SCREEN when you fight her.

To emphasize their instrumentality, the names of political parties and newspapers consist of mere interjections with no meaning.
