Death penalty is very rarely given by judges. And is only legal in about 50% of states. And even in those states most judges do not want to give someone it unless they are the worse of the worst. Not having the death penalty as an option is just one less thing keeping someone from doing a major crime. Completely aboloshing capital crime is not a sign of advancement but a sign of appeasement. The fact that a person in say Sweden could theoretically kill millions of people, and get off with nothing more than life in prison, is absolutely absurd.
