It's more about you not being required to ask because the seat doesn't belong to the stranger.

On public transit the ride is also quite bumpy so if an older person is looking for a seat but they have to go through a whole exchange to get someone to move their shit out of the way the driver is already driving before the person bothers. Lots of shit heads also take up priority seating for elderly and don't move when they get on.
