日本では、この文書に記載したような現状ですので、知的所有権を尊重する気風のある欧米の企業に発明を商品化して頂く方が、この美しさを世界中に広める近道だと考えています。
別に、欧米人が善人で、欧米の企業が良心的だと思っている訳ではありまません。
欧米の企業が知的所有権を尊重するのは、欧米では知的所有権の侵害をして、訴訟を起こされて敗ければ、その賠償金の額が数十億円、数百億円になることも珍しくなく、更に、その上の桁の賠償額になった例も有り、企業の存亡にも関わりかねないからだと思います。

米国では、権利の侵害が悪質だと見なされた場合には、通常の損害賠償金の上に、更に、その数倍(最高400%?)の懲罰的賠償金が科されるので、知的所有権の侵害が割に合わないことを、多くの企業が認識していると思います。

また、欧米は訴訟社会で、些細なことでも訴えられ、それを引き受ける弁護士も過剰?といえるほどにいて

その賠償要求も巨額になることが多いので、多くの人や企業が、権利を侵害して訴えられないように用心していると思います。
また、欧米では人々の正義感が強く、企業倫理に対する目も厳しく、不正義と映るようなことをして、それが公になった場合のイメージダウンが甚だしいからだと思います。

また、欧米では、相手に少しでも権利を証明するものが有れば、権利を侵害した側が裁判で敗ける可能性が高いからだと思います。
また、裁判での勝算が有りそうな係争で有れば、報酬のパーセンテージは相当に高いようですが、成功報酬制でも請け負う優秀な弁護士が幾らでも居ると思います。

もし、試作品を送っていれば、私が送った企業とは全く別の、私の意に反する企業の人間が試作品を手にしていたことでしょう。
ある時、メーカーに、ある発明を売り込む手紙を出したところ、私に電話が掛かってきました。

その用件は「写真に有る試作品を五台ぐらい航空便で送って下さい」とのことでした。
先方が電話を切る直前に、受話器を通して、かすかに含み笑いが聞こえたので、そのメーカーが記載されている英語の資料を詳細に見たら、なんと、日本のある大企業の子会社でした。

そのとき、曲がりなりにも社会に名の知れた企業が、こんなたちの悪いことまでするのかと呆れました。

また、発明を売り込んだ企業の中には、その社の製品を、その社から直接、通信販売で買ってくれたら、その社の発明会員にしてやるとのダイレクトメールを送ってきた常識外れの企業も有りました。

私の思考には全く無いような『さもしい』ことをする上記のような様々な企業や人間には、ほとほと、ウンザリしています。

発明歴二十数年、これまでに様々な多くの企業に発明を売り込んできた私の結論。

上記の出来事を、顔見知りの社長に話したところ「実際に私の所に出向いた『証拠の写真を』提出すれば、私から何も聞き出せなくても、新幹線代プラス、日当5万円位は貰っただろう」と言いました。
発明を売り込んだ企業からの返事の中には、封筒には、しわ一つ無いのに、便せんは、一度握り潰して、それを広げたしわだらけの便せんということが有りました。

また、世間に名の知れた企業の中にも、素人でも分かるようなことで問題をすり替えて、あたかも権利に成らないかのように思わせようと、私の発明にケチを付けてくる企業が何社も有りました。

それを見ても、この程度の頭の人間が、特許部長や企画開発責任者では先が知れているなと思える だけで、その頭のレベルの低さに相手にする気にもならず、呆れて腹も立ちません。

また、二十数年も発明家をしていると、その間には、初めから契約する気など全く無いのに、私の足元を見て、試作品を見せに来てくれだの、試作品を送ってくれだのと要求する企業や人間を、飽き飽きするほど見てきました。

発明家の足元を見て、自分の思いのままに人を動かすことで、満足感を得ようとするような心の卑しい人間にはウンザリしています。

更に、親会社の指示を受けて、あたかも、その企業が私の発明に関心が有るかのように装って、試作品を送らせようと試みたことが何度も有りました。

もし、試作品を送っていれば、私が送った企業とは全く別の、私の意に反する企業の人間が試作品を手にしていたことでしょう。

ある時、メーカーに、ある発明を売り込む手紙を出したところ、私に電話が。

既に、その男の意図が分かっていましたので、私は会うことを望みませんでしたが、近くの駅まで来ていると言われれば、仕方がないので迎えに行きました。

その中年男を自宅に招いて、新聞記事で見たと言う発明の試作品を見せましたが、その試作品には、ほとんど関心を示さず、様々な話を持ち出しては、私がどのような発明を持っているかを執拗に聞き出そうとしました。

私は、その男の正体を承知していたので、どのような発明を持っているかを、あの手この手で執拗に聞き出そうとしても、一切教えませんでした。

最後には、聞き出すことが無理だと悟ると、その男は、折り畳み式のカメラを洋服の胸の内ポケットから取り出して、ほとんど関心を示さなかったはずの試作品の写真を撮らせてくれと言いました。
その目的は見当がつきましたが、何の利害も無いので承知しました。

その男を駅まで送って行くと、その場になっても、まだ、「貴方が持っている発明の内で、有力なものを全て手紙にして送って下さい」と言いました。

そして、その中年最後には、聞き出すことが無理だと悟ると

その男に会った時点では、まだ新聞記事を見ていなかったので、その男に、「どのような記事でしたか?、写真は載っていましたか?」と訊ねたところ、親指と人差し指で四角をつくって「こんな小さな記事で写真も載っていなかった」と答えました。

その後に、図書館に出向いて新聞記事を見たところ、その男の話とは大分違って、記事も大き

私は、そのほか様々な体験から、日本の企業の企画開発担当者や技術者の外部の発明に対する思いを知りました。
大多数の企業では、その社の社員の発明より、外部の発明が上であれば、上であるほどに、それを認めれば、逆に企画開発担当者や技術者の無能さを晒け出すことになり、ひいては無駄飯食いと言うことにも成りかねず、どれほど素晴らしい発明でも、受け入れられる可能性は皆無に近いと思います。
上記のような企画開発担当者や技術者は、外部からの発明の売り込みの手紙を見て、その発明のレベルが高ければ高いほどに

それが自分の立場を脅かす存在と映り、ますます顔を強張らせて「商品化に反対!」と言う言葉以外には言葉が出ないと思います。

果が望めない、真の抜けた商品が売り出されることが間々有ります。
私からすれば、こんな、最初から売れる見込みの無い、先行投資した分の回収さえままならないような稚拙な商品を、新商品として売り出すぐらい

しかし、このような企業の企画開発担当者や技術者にとっては、社外からの発明を受け入れることは、自分の存在価値を否定することにつながり、企業にとっての利益を考える以前に、自分の保身を第一に考えなければならないのではと思います。

「素人は真似されることを恐れ、玄人は真似されないことを恐れる」と言う諺からすれば、真似されるということは、その発明に価値が有ることの証には成りますが、結果としては、人様のアイデアを盗むことぐらいしか出来ないような無能な人間を手助けしたことになり、私にとっては不本意です。

それは、記事を見ただけで、これを買う人はいないだろう。何処も真似をしないだろうと思うような稚拙な商品でした。

案の定、その後、その商品が売れたと言う話もなければ、商品として展示されているのも、実際に使われているのも一度も見たことが有りません。

上記の出来事で、企業の企画開発担当者や技術者や経営者の外部の発明に対する心中を垣間見た思いがしました。

日本には、まだ、知的所有権を重視し、尊重し、知的所有権に対して、その使用権料を支払うという発想を持たない企業が多く、大企業ですら、『ただ』で、よそのアイデアを使うことを考える企業が有ると思います。

ガリ弁秀才をはじめとする単なる労働力を大量に集めて、欧米で発明された技術を巧みに模倣した高品質の猿真似商品を、資本力にものを言わせて大量生産し、従業員一人当たりの利益の低さや、製品の利益率の低さを規模の大きさでカバーして、それにより大きな利益を得るという経営手法は、既に時代遅れになっていると思います。

これからの時代は、商品に付加したアイデアや意匠などの知的な部分が、商品価格の多くの部分を占めるように成るのではと思います。

いくら高品質でも猿真似商品では、コストに利潤を上乗せしたメーカーにとって妥当な価格を付けても

その商品を消費者が支持するとは限らず、日本製ほど高品質でなくても、その商品に見合った性能と耐久性が確保されていて価格がより安ければ、賢い消費者は、そちらを支持すると思います。

その場に同席した社長が、それを諫めるかと思いきや、逆に、その男と社長共々に、私がどのような発明を持っているかを執拗に聞き出そうとし、聞き出せないと分かると、その社長は捨て台詞のような啖呵まで切りました。

その社長は、ある世界的に名の知れた大企業の名を挙げて「あの会社は真似専門で大きく成った。世間では皆、会社名を捩って『まねした〇〇〇』と呼んでいる」と言いました。

更に、その社長は「よその製品のアイデアを真似して自社の製品を造って、一年か二年の内に売りまくればいい。もし訴えられたら『知らなかった』と言えばいい。真似した者が勝ちだ」とうそぶきました。

その他にも言いたい放題のことを言い「特許や実用新案なんか効果が無いが、内は良心的だから、内にアイデアを教えてくれたら、特許や実用新案を出願してなくても金を払うから、どのような発明を持っているか教えてくれ」と執拗に迫りました。

その非常識さに、そちらの都合で、私を遠路わざわざ名古屋まで呼んでおきながら、よくこんな事が出来るなと呆れました。

内心思っているだけでなく、実際に「アイデアなんか盗んで使えばいい」と広言してはばからない企業経営者が居るとは思いませんでした。

そのとき、こんな志の低い人間がやっている会社は長いことないなと内心思いました。
その帰り道、車を運転しながら「足元を見られて騙された」という思いで腹が立ちました。
その数年後に、新聞の新商品を紹介する欄に、ごく小さく、その企業の新商品が載りました。

もし、才能を発揮でき、自分の発明した理論や技術が世界中で使われ、その才能を世界の人々に認められたら、どれほど名誉なことだろうか。

もし、本当に頭が良いと思ってい、それを発揮できる恵まれた環境を与えられているのであれば、世界に認められるような発明、発見、研究、創作などを成し遂げて、日本に次々とノーベル賞をもたらして、日本にノーベル賞の山を築いてみろと思っています。

しかし、所詮、親の七光りだけでは、どんな素晴らしい環境を与えられても、エジソンにも、アインシュタインにも一歩も近づけないと思います。

また、誰がやっても、遅かれ早かれ同じ結論になるような研究成果しか挙げられない人間が、研究者として生涯生きられるのでは、欧米の研究者のレベルには及ぶべくもないと思います。

私は家庭の事情で充分な教育を受ける機会を逸し、その為に自分の能力を発揮する場が無く、不遇の人生を歩んできました。次の代では、実力本位の海外に出てでも世界に認められるような人間になってもらいたいと思っています。
振り返れば、試作材料などの入手の為に、何度となく足を運んだ名古屋などでは、様々な所で、数多くの親切な人に出会いました。

名古屋の電話帳を見て、私が必要とする材料を扱っている業者を捜し、その業者を訪ねて行くと、思った以上に立派な建物を構えた会社であることが間々有りました。

その立派さに入るのを、しばし躊躇しましたが、わざわざ名古屋まで来たのだからと、意を決して入って用件を伝えると、どの会社でも、予想した以上に親切に応対してくれました。

明治期においても人糞は貴重な肥料であり、高値で引き取られた。そのため、学生などが下宿する場合においては、部屋を複数人以上(具体的人数はその時の取引相場で異なる)で共同で借りた場合は、部屋の借り賃が無料になることもあった。

肥料として用いる人糞は、そのまま使うと作物が根腐れするため、たいていは肥溜めに溜めて発酵させて利用する。

ちなみに発酵中の物は非常に臭いが強く、さらに衛生害虫になるクロバエ類やニクバエ類、またカの中でも最も富栄養状態に適応したオオクロヤブカの発生源となるなどの問題があった。

また、人糞肥料を媒介とした寄生虫の流行も問題となった。

農民が直接人糞を引き取る形態は、バキュームカーや下水道が普及した事や、前述の肥溜めや寄生虫等の衛生上の問題もあり、昭和後期以降において廃れることになった。

しかし、現在も下水の汚泥を醗酵処理した肥料が製造販売(自治体によっては無償提供)され、人糞等を原料とした肥料は利用されている。
