Unless published under a creative commons license, anything an artist designs is automatically legally their own intellectual property. In using their designs, you can be subject to legal punishment if the owner of the rights does decide to take action, or blacklisted from selling in the market by the community.
You can laugh, but these teens make up to $900 per design in even just one auction (http://nemcrsd.deviantart.com/journal/closedspcs-muzumimi-565753399) by properly marketing one simply creative idea with about 5 hours of illustration and making other artists want to pay for the rights to make one of their own.
Its more initiative in entrepreneurship I've seen from most adult artists like you, who sneer upon them when nothing is even stopping you from taking advantage of the adoptable market, too. You'd look like an idiot copying the designs and getting sued when you should be taking a note and learning from them as a businessman.

Yes, and goddamn the market is booming despite it being in its maturity stage.
As someone that once made a closed species, it was pretty fun from a creature design standpoint and a way to make pocket money.
I never leaned toward "sparkledog" designs but I can see how those would have made more money in the wolfaboo communities. I like to look at realistic and creative creature designs, which are few and far between with closed species unfortunately.
I do agree it's a dumb concept in the long run due to the idea of trying to police others to not draw your thing. I still sometimes feel rebellious whenever I see one, "I can draw that shit and you can't stop me." However, in small communities it is a nice way to spread creative ideas and art around. Character markets in animal-drawing communities are a big thing (ie buying and selling of drawn characters), so closed species are not too far fetched.
Suddenly thinking back, I did a similar thing in primary school by drawing 'pound dogs' on bits of paper and passing them around like virtual pets.

Whenever people mention the fact that people CAN sue you, most neglect to say almost all of them do not because lawyer fees alone would cause it to be an unprofitable decision. And most teens don't exactly have good connections with lawyers and lawyers don't really take a 17 year olds case about "they stole my OC" seriously.
