Same as in the military, if you are made to do something bad by your superior officer, the superior officer gets in trouble. The grunt doesn't, however.
Bringing about an unlawful, or a socially damaging action, which would not of occurred without the persuader's intercession.
While the argument could be made that the person may have committed the offence regardless, the case at hand is one of actuality and not speculation.
The key word at the end is intent.

Wrong. You are legally obligated to disobey an unlawful order, i.e. one that would be a war crime, if one is issued by a superior officer. "Just following orders," is not a valid defense.
