Unrestricted submarine warfare only applies if you are sinking civilian ships which are affiliated with neutral countries. Neutral being the key word. American submarines attacking Japanese cargo ships is not an example of unrestricted submarine warfare, because Japan was not neutral, therefore vessels affiliated with Japan did not have the protection of neutrality. And Donitz was charged with other things besides that.

Nimitz is a credible source so I will accept that. And after doing some reading, it appears that The Nimitz letter was accepted by the prosecution. Thus, although Donitz was found guilty of unrestricted submarine warfare, no time was added to his sentence because of it. The 10-year sentence is purely a result of unrelated charges. For example, Donitz knew that 12,000 foreign workers were being used as involuntary labor (AKA slaves) in German shipyards. He was aware of this and did nothing to stop it.

Charges against him for his submarine war were dropped when the defense proved that the Allies did the same thing. He WAS found guilty of ordering attacks on neutral ships, but no additional prison time was added for that charge.
