Because the founding fathers were enlightened gentlemen who didn't respond to the very first opposition they experienced with violence.
It is telling that even when Hamilton had a strong personal rivalry with Jefferson for much of his life he still intervened on his behalf against the corrupt Burr, to the detriment of his own faction.

It wasn't illegal to free slaves. It's just that if they stayed in Virginia for a year, they'd be put back into slavery, so you not only had to free them but secure them transportation and means in another state.
