the court system would organically develop a bill of rights over time that would change with circumstances, rather than codifying a bunch of rights that may lose relevance over time (third amendment) or be unfit for future societies (how liberals feel about the second amendment). leave it to the judges to come up with new rights according to how they feel (abortion, marriage). doesn't reflect how I personally feel but i think this is how they'd respond.
