If you want a peaceful and stable government, then assassination might be justified. But when people know it's an assassination, it only sets a precedent and creates more turmoil allowing for future leaders to be assassinated. Therefore the ends is not truly accomplished due to the means.

The difference between the can-be and is, is whether or not the actual desired ends are accomplished. It's basically monkey paw, etc. The means is wrong because the ends while technically achieved, was not the actual desired ends as intended.
