I'm suggesting there would be improbably fantastic reasoning to show India having more rape per capita than USA. The number needed to match US levels of rape is just too much in almost any real life scenario.

Here's some number and graph crunching. India is literally at 2% of what the US rat us at. The under reporting suggests US has nearly 50% under reporting. This would increase distance even further.

But the point is both country has under reporting. The under reporting needed in India would have to be exorbantly huge to catch up to the US.

The definition of rape depends on the country, however the base line stays same. Rape is wrong done against women. Each country has different opinion on what can be seen as wrong. On each country cultural and historical morals, and values are different. So maybe forcing wives to have sex with husband is rape in some countries. Maybe if you don't sign a consent form, you are literally subject to rape if a women ever demands one. No matter how many days it's been done, or no matter the verbal agreement.
