why exactly do we, as humans, deserve rights?
I understand what basic human right are, but what exactly constitutes us having them? why are we supposed to have human rights?

It's an extension of the generic "do unto others..." idea. Basically saying everyone has the right to these things is a way of forcing everyone to stay on the same page in terms of how violently to interact with one another.
Everything is a spook, but this in particular is a spook that tends to produce positive results for individuals.

Because the people who championed the idea either were able to influence the ruling government enough so that they recognized it, or they founded their own states where they could enforce the idea.

Governments grant privileges, not rights.
Governments merely recognize rights. Governments can, of course, infringe upon rights unless said government possesses some legislation preventing legislators from infringing upon said rights (The US Bill of Rights does this).
