#1 Who said petty theft carries a death penalty? Not in America.

Let me be clear though: threatening someone with a gun is NOT petty theft. Regardless of what their intentions or reasons are. If someone points a loaded gun at your daughter and says "don't worry I'm not going to hurt you. You have pretty eyes!" that carries the same weight of danger as pointing it at a shop owner and saying "I'm going to kill you no matter what you offer me." You cannot trust the motives or intentions of someone threatening to shoot you and you are allowed to use whatever you have at your disposal to eliminate the possibility that they may kill you or another innocent person.

#2 Lethal self defense is not execution. Execution is a calculated process whereby a court decides that what someone has DONE is heinous enough that they are likely irreparable and should be ultimately removed from society. Legal punishment is a final resort. The real goal is to prevent it from happening in the first place. I would be surprised if you would argue that a dead armed robber who threatened to kill someone is not better then a dead shopowner who decided to give a thief the benefit of the doubt.

Your argument would hold some water if there was any such thing here as executing someone for minor theft, but there isn't, so it doesn't.

If the punishment for stealing a loaf of bread is a fine, then if the thief is caught he will probably give up or run. But either way, he will cut his losses and try to avoid escalating the situation.

If the punishment is death, then if caught he will try to eliminate witnesses. Increasing the severity of punishments increases the stakes for getting caught and removes the incentive to cut losses and avoid escalation.

Punishments have to be carefully balanced between being severe enough to deter crime and lenient enough to avoid giving someone the motivation to escalate the situation.

Here's another example. If the punishment for breaking into a house, stealing everything, and leaving is the same as the punishment for breaking into a house, murdering the occupants, stealing everything, and leaving, then why wouldn't the housebreaker kill the occupants? Doing so, despite it being a clearly more severe offense, does nothing to increase the severity of his punishment if caught, and also decreases his chances of being caught by eliminating witnesses. That's why those two crimes are punished differently. That's why you can't just ramp things up to 11 for every infraction.
