We can. People have done packet sniffing, as well as other outgoing traffic testing. On top of that Microsoft released a document which says what they are (legally) collecting. Which is a lot. Keep in mind that Microsoft owns a bunch of other services too, like LinkedIn. (And can partner with any in the future) and just link your browsing habits, documents, pictures, etc. to your career, and potentially more of your profiles.

Not exactly. Telemetry is still active. Your PC gets a unique Ad ID too. Everything is still possible to being linked to you. Going through the privacy settings is a pain since they can be reset with just any update (speaking of experience here, with the upgrade to the anniversary update) as well as a lot of them aren’t explained well or hidden in sub menus.

It is not illegal to have secrets. In fact it is encouraged to keep some things to yourself.

Microsoft is a company. They make money from hardware, software and advertising. The latter paying only decently if they use user specific information to target personalized ads. Microsoft has all the reasons to sell your information. On top of that they own a lot of other services and work together with even more, so they could potentially link these “small” bits of information together. If not Microsoft themselves, maybe a partner, or maybe even the government. This can affect your life. Banks can deny you loans, companies can fire or deny to hire you, or worse. This information may or may not be linked right now. But it’s only better for the user the less information they can gather from you.

I'm pretty sure what microsoft do with data is safe enough.
The problem is having a bunch of "green" internet services running at all times on your computer, just waiting for getting exploited by some chinese kid.
And if one box gets exploited, all boxes get exploited.
