The first radio transmission was what ~100 years ago? If someone intelligent was within 100 light year distance, we would have heard something from them, not necessarily as replies to our transmission but rather their own transmission. So we assume they are beyond 100 light years. The problem with such assumption is the further they are, they would see what earth was more than 100 years ago. Continuing this argument, we may say they might be seeing dinosaurs on earth from their telescope or just volcano in primitive earth or no solar system at all.
