Depends on the VPN and how you acquired it and how you set it up. Properly set up VPN doesn't help if the company is willing to give out your info/saves it on a compromised/compliant server etc. But as far as torrenting goes, I really, really doubt anyone is going to go through all that effort and have that possibility of failure still when trying to get someone on just piracy charged, when there's a shitload of people who don't have any protection and are just downloading away.
