https://www.eff.org/deeplinks/2017/05/secret-new-european-copyright-proposal-spells-disaster-free-culture

Wtf is this?
>The losers from this proposal are fourfold. Perhaps the biggest losers are the creators themselves, who will face new barriers between their art and their fans and collaborators. The streaming services will also lose out, as they will face higher expenses and will no longer be able to operate non-commercially even if they only carry freely licensed content. Fans, of course, will suffer because of the reduced legal availability of free music and video online. And even the copyright industry will suffer, as the increased costs of legal streaming services may cause creators and fans to shift back to peer to peer file sharing, where copyright infringing works are also exchanged.
Yeah, sure, we are going to make tremendous bullshit law like data retention directive, we'll just force everyone into no-brain fuckery how our masters play. Puppets. And no awakening on horizon.

Currenyly the police is only allowed to intervene if copyright holders request it. They want to change this so that streaming would be only legal if certain conditions are met, which should give police more room to operate in.

READ THE FUCKING ARTICLE BEFORE YOU COMMENT, RETARDS

1. Member States shall ensure that, when authors and performers transfer or assign the right of making available to the public of their works or other subject-matter for online on-demand services, they retain the right to obtain fair remuneration derived from the direct exploitation of their works present in the catalogue of those services.

2. The right of an author or performer to obtain fair remuneration for the making available of his/her work as described in paragraph 1 cannot be waived.

It literally just says that the author always retains the rights to monetize their work, regardless of license. How does this change anything?

Actually on second thought this just means that you are still free to let people use your works, bit at any time you have the right to ask for compensation if you feel like doing so.

This just means if your release something under GPL you cannot revoke your decision if you regret it, but with the new system you may change your mind and ask money either way.

For example you could choose to request a compensation of 0$.
>>
>>60426232
This poses an even more interesting question, this law is actually to protect the people NOT corporations.

Since a company cannot give me a contract anymore where they force me to sign that I give up all my copyright related right so they can profit of it with more shekels.

Even better if they ever fire me and I wrote a lot of code for example I could demand fair compensation for the amount of code I have written. Or sue them if they are not willing to do so. They would have to rewrite a large of the code if they wanted to do so.

I believe there are also lower taxes in profits brought in by copyright.
>>
>>60426321
Jeezes Christ this law has huge consequences. It would mean that a company is not owned anymore by one Shlomo Shekelberg but by anybody who gave creative input for said company.
>>
This is just going to legitimise piracy again.

The CAN share it freely.

You can still make your stuff freely available. But if at some point you decide to monetize it, you can monetize it from that point on.

Nobody is forcing anyone to pay anything.

Generally depends on the contract.
Pretty sure that for code, any code you do for work is owned by the company. Though there is some question about if you do code in your free time and then implement that code into a company project if you would lose your copyright ownership. It probably would be the case.

Pretty sure, though, for cases like musicians the company (label/publisher) is a joint copyright holder. So if they find a way to increase their profits off your work without giving you any more money that would be stopped under the new proposed laws.
>>
>>60418997

>hey you know that free video my family member made before they passed away and I now have the rights to it?
>because I'm a greedy jew I want you to pay me my family member's fair share or shut down
It's a liability. There's a reason people use CC licenses instead of just using a blanket "sure, go ahead and use it:" it GUARANTEES that everyone will be able to share freely without haing to worry.

Yes while it does protect private individuals it also gives them quite a bit of power over when it comes to abusing it.

But including any exception in this would make the whole law moot since anybody would just try to conform to the exception.
>>
>>60428463
This law assumes that people would only give up their right to "fair renumeration" if they didn't know any better or were otherwise forced to by a publisher. For those of us who give it up knowing full well what the consequences are and in fact consider the act of sharing their works to be all the "renumeration" we need, this law is taking that away.
