Adblockers do not actually "block" ads, they simply do not request them. Because of the way HTTP works by default all types of content are "blocked". Web browsers are set to automatically request certain types of content when you stumble upon them but "adblockers" are like taking a second look through the requests before you actually send them. You double check and making sure you actually want the content you're requesting.

As long as HTTP functions based on client requests rather than the server pushing content to the client it will always be possible for the end user to simply not request content they do not want.

I'd like to see a judge anywhere in the world actually uphold that, though. I don't think it's gonna happen. First they would have to properly establish that this part of his website was in fact "non-public" and that's going to be pretty hard if he's allowing it to be crawled by search bots. Just slapping a javascript on it to obscure the page under certain conditions isn't going to be enough to prove that, certainly not in court.

Also they would need to have a way to demonstrate informed acknowledgment of those conditions on the part of the person viewing the website. Shoving a 50-page "terms and conditions" boilerplate in front of them with full knowledge that nobody is going to read that shit is going to be really shaky in front of most judges, for it to really stand it would have to be very concise and easy to understand, and it would be necessary to be placed in such a way that it is impossible to view the ad-supported content before first giving your consent.

In Europe you see many websites have a cookie warning, which you have to click through to enter a website, is enough to get the consent of someone.
I don't see how an agreement to allow ads would be any different.

It can be hard to prove who visited your website, but that's the only obstacle I see. And there is no reason why you can't make a distinction between search bots and humans. Both are two different parties. There is no legal reason why you should treat them the same way.
