Case insensitivity isn't some thing inherently built into computers, uppercase and lowercase letters are different entities. All code is like this. It's just fabricated into some programs for convenience's sake.

This is an "issue" with EXT4, not the kernel.
I'll also add that this is not an issue. Why are you capitalizing your directories? I think you're the problem.
