Stopping him from boarding would be one thing. Overselling, letting people board and then letting a pseudo-RNG decide a customer should get royally fucked over because the company's policies are terrible is all fine and dandy to you because you 'respect private property', then? Because I like to think I do the same, but the law is on the doc's side.

This thing about the "terms of use" making a company able to legally kick you off a plane for arbitrary reasons is false, and has already been debunked many times in these days with documents and interviews to lawyers. Anyway feel free to provide a link to the "terms of use" and to quote the part that you think covers the company, i'm really curious.

Airlines actually overbook every flight as a few people dont show up or miss it and dont get a refund. Usually it isnt a problem but sometimes people show up and dont leave. Usually they're given a new ticket for the next flight and sometimes they get dragged out
>>
>>59858190
I dont get the whole overbook thing in the fact that if they sell 130 tickets for 130 seats, and only 1 shows, then they have still covered expenses. The seats are paid for.

It's blatant (to me) that they are using some asinine law to extract maximum profits.

Hell in the US alone, air carriers expect to make 18b USD this year.

So far I've read both that the algorithm used to decide who ges kicked off the plane is random or that it's designed to make a pool of late bookers and pick from those since they take the cheapest payout (which is a multiple of their ticket price)
Which is it /g/?
>>
>>59858652
They are terrorists at this point desu

And in the terms and conditions for that ticket it indicated that the airline may at any point move the passenger to another flight.

You do read the terms and conditions when buying shit, right? Because if you don't and just clicked accept things like this could happen and you'd make a fool out of yourself trying to argue about it.

it's cancer. It's using some sort of taxonomy magic so that they get privileges and gibs.
You don't meet a person then, you meet a gaytransbicuriouspansexual colored person. Their whole personality revolves around that crap, and it's creepy. Kinda like meeting a guy who likes Starcraft and his whole world revolves around Starcraft, but at least Starcraft is fun and you won't get fired, socially destroyed and overall demonized for not liking it, though maybe you'll be called a pleb.

Identity politics are a great diversion from what really matters.

do they cover beating the shit out of a degenerate doctor that gives drugs to young boys and then rapes them? yeah, probably.
>>
>>59858795
It so may be, but as soon as you take the offense and harm a passanger so that your company's terms are upheld you are in the wrong. If such conditions are in order, their best move would be to have someone responsable tell the passanger it works like so, and if he still refuses, tell him the legal implications of his actions.
>>
Why don't they just stop overbooking flights?
>>
>>59858877

>>59858918
Apparently there is an expected amount of people to not show up for a flight, so they oversell hoping that only about 60% or so (numbers pulled out of my ass, but you get the gist) of the clients show up. It's a strategy so that they dont get a semi-empty flight.
>>
>>59857274
You cannot get passanger out of a plane (not just deny boarding) forcefully unless he is doing something wrong, whether it was overbooked or not. Police cannot do it forcefully just because crew told them so.

Both police and crew are fucked up.

There's an effective time and manner to stand up to things like that, and it's not getting in the face of security. They're not going to undo their decision in the face of complaints. All they'll do is escalate the scope of their actions since interfering with them would be grounds to detain others.

Several recordings of the event made by people who kept quiet (and thereby got to keep their recordings and share them as soon as possible) are among the most valuable products of other passengers' actions.

>>
>>59859566
A PR disaster for an airline is a crash. This is just run of the mill negative PR. Its net effect on the financial situation for United was 1% on stock value, if it can even be argued that 1% exceeds normal fluctuations.

They'll also compensate him only as much as they need to for him to accept. He's not going to accept or demand any different amount of money just because he has compassion on his side. Nor will United offer him more than they need to just because they feel bad.

I wonder if you're getting fooled by some sort of internet echo chamber about how significant this is. It made top headlines on major news outlets for barely 12 hours overall. It's now a third-level story on the few sources I just peeked at.
>>
>>59859626

Because when margins are thin (not speculating on the reasons or truth behind that), money left on the table is bad under any circumstances. Even if they didn't expect to make money for >100% of seats selling, it's a cardinal sin to miss that money if they can grab it. It's why they lament underbooked relocation flights so often. As much as they need the plane to be in a particular city later in the day, they hate having to pay its flight costs without milking every penny possible.

Yes, but this method, I assume, renders more money, less flights required since "some passangers will fail to show up", making more money per flight. Just a stupid, uneducated guess anon, but seems to make sense.

>they just arbitrarily decide their staff take priority.

thing is, it's not like they chose to give their friends a ride here. It was operationally important to get the crew where they needed to go or more people were going to get stranded. It starts a domino effect if they have to cancel a flight.

You people have no idea how airlines operate and yet spout ignorant shit. It's like when an aircraft has an accident every fucking steve joe is suddenly a decorated crash investigator.

Looks like you're the 12 year old here, faggot. If a crewmember tells you to get off a plane, you get off the plane. They have the authority and are responsible for every soul onboard - if they so choose they can simply bump you off their plane.

That asian faggot didnt act like an adult, nor did the airport "police", but united is kinda innocent. After all, it wasnt even their aircraft or flight

That certainly sounds ethical. It may even be the legal obligation according to UA's contract of carriage. But it's certainly not the most efficient from a business perspective.

Kicking someone with dollar-for-dollar compensation would destroy customer trust. Kicking someone at, say, 4x compensation would start to cost more money than just booking a new flight for the transferring crew. Somewhere in the middle is the sweet spot where you take a little bit of a hit in exchange for securing your revenue on the flight that this transferring crew will be running. And yes, that sweet spot even accounts for the one-in-a-thousand case where a kicked passenger creates a scene like this one. Because the other 999 times you just get someone who makes an angry tweet and maybe never flies UA again. Big whoop.

In short I think that even with what happened, from a purely capitalist perspective UA did the smart thing and would even keep doing it unchanged in the future.

>I just posted two sources gainsaying that.

Both are related to this drug trafficker case, not on crew's authority on personnel removal.

However like I said, the crew (captain making the final call) has the authority to remove anyone from their plane. That is true, I guarantee you 100%. I've sat through weeks and weeks of classes on aviation law. This is plain as water. They DO have to give their reasoning for removal, and will not do that on light reasons, but they absofuckinglutely have unarguably authority to deny anyone a ride on their aircraft.

Too drunk? You get thrown off. Belligerent? Off you go. Unruly? On no fly list.

I do not agree how this specific situation was handled, and I despise american police's trigger happy methods, but to say that the crew which is responsible for safe flight has no say who travels on that aluminum tube with them is false.

>>
>>59860781
Not him but they do have the authority. What they don't have is legal immunity having performed that action unjustly. Authority is the ability to do something, not a defense from the consequences.

What you two have been doing is conflating the crew with the carrier. The passengers have a contract with the carrier. Therein lies the question of whether United had the authority to violate their contract.

The crew's authority vis a vis the contents of the aircraft comes from the FAA, not in their capacity as representatives of the carrier. That's a separate question, one of whether they exercised that particular authority justly. It's not the question of whether they have such authority in the first place, however. They do.
>>
>>59860873
The FAA is not above the constitution, and every one has a constitutional right not to be discriminated on the basis of race.
>>
>>59860873
>it's not a question of whether they have such authority
That stop muddying the waters by repeatedly bringing that into the discussion, retard.
>>
>>59860902
And that would be a question of misapplication of authority, not whether it exists in the first place.

Authority is the ability to do something--justly or unjustly--and not a defense from the consequences.
>>
>>59860939
>let's discuss semantics instead of actual facts
>>
>>59860934

>>
>>59860968
How nice that it settled all of the conflict over the facts too.
>>
>>59860873
That is a technical detail. Call it an abuse of office.

The point here is that the customer had every right to stay in his seat and take that flight. It has been proven multiple times that the company was legally bound to provide for the service the customer bought. His forceful removal and the physical harm that followed were unlawful under every single point of view.
>>
>>59860902
Dont bring the constitution to this, the US is one of the founders of ICAO which makes the flight rules and every member state adds to their own lawbooks.

Like I've argued, the crew has the authority. It's an honor based system, the crew is given a tremendous amount of trust on their shoulders. If you throw a colored person off the plane you might not only lose your job next day but be perceived as not having a balanced moral standing and you might lose your licence, as well.

They might or not had the right to deplane the gay sex drug trafficker, I'm not saying anything on that one. They absolutely had no reason to smack his head to armrests, which united didn't in fact do, some jeans wearing hillbilly "police" did. And not even on an united plane. God this is a stupid discussion as media has warped everyone's view.

Again, as far as I'm aware, yes.

You don't have a right to a force field against grievances. What you have is the right to petition the government for a redress of grievances. That's not a technical detail, it's a foundation for how the US operates. Sometimes we need to give people the latitude in their authority which allows for them to fuck up. What follows is that we also need to be okay with understanding that the fuck-up will happen, we'll live with it as it does and we'll make amends and learn from our mistakes later.

Pedantry time: not explicitly, nor absolutely.

Re: explicit - application of the 14th Amendment is limited to a handful of particular classes thus far. Namely those are race, national origin (this is not the same as ethnicity), religion and whether you're a resident alien, followed by gender, legitimacy, and sexual orientation.

Re: absolutely - this is why I split the above list with "followed by" and even omitted many related classes from the list. "Forbid" isn't common language in Constitutional law. What happens is that laws which are challenged under the Equal Protection Clause have to pass a test. For the first group I listed it's the Strict Scrunity test,
>"narrowly tailored to a compelling interest"
and for the others it's Intermediate Scrutiny. There are also lots of discriminatory laws which are tested against Rational Basis. Each of these is successively less stringent but you'll see that even the strictest isn't an absolute.

It can be perfectly legal to make laws which discriminate against suspect classes as long as they're narrowly tailored to a compelling interest of the State and are as least restrictive as possible for the purposes of that interest.

Ethnicity is not a suspect class, and even if it were there is not an outright forbidding of discrimination.

Boarding is the present participle of Board. You need to be in the action of getting on the plane to be Boarding.
As a noun, it is the action you take to get onto the plane.

Boarding happens before you get on the plane and ends when you are on the plane.

You don't know shit son.
