Stealing is what most of the people using the emulator take the next step of doing.

As long as the emulator itself isn't written using stolen code(ie: the console's functions are reverse-engineered legit from scratch without a legally signifigant snippet of nintendo's own work,) the emulator itself is 100% legal to make and to possess.

They can even stop giving it away and sell it instead if they want to. Still legal if those conditions are met.

Serious reply:
1. It isn't worth doing for the money. You can't do it alone unless you're a literal genius. Realistically, you'd have at least four team members, which means your income from the project would be <$120k/year. You can earn that doing more conventional programming.
2. More importantly, the skillset for building high-end emulators is a very specialized blend of reverse engineering, JIT complication and low-level graphics programming. Learning each of the three to an intermediate(ish) level is fun, not too hard and a good time if you're a skilled programmer looking for a challenge. But getting from there to the expert level required for working on a cutting-edge emulator is grueling hard work you would do for free. It'd take years. You need passion for this kind of thing, and I don't care enough about emulators or vidya.

That's wrong as real life cases have shown it is possible to produce reasonable cause by directly examining the binary with all sort of analysing tools or perhaps just looking straight at the strings a hex editor spits out. The free software foundation does it all the time. Take a look at the ffmpeg homepage and their list with offenders and how they found out about it.
