put the pi in mcdonalds, give it a dyndns or equivalent dynamic-dns host and vpn in to it that way

or find some office to put it in above a ceiling tile or something.

Sure they can. They can throttle everything by default UNLESS they recognize you are doing something they let you do unthrottled.

First thing I'd do if I ran an American ISP is throttle anything I cannot read using deep packet inspection. VPN BTFO.
