I often get the legacy CAPTCHA wrong 2 or 3 times recently. I wonder if Google started a similar system like with their newer CAPTCHA to combat niggering. Let the user solve one or two CAPTCHAS in order to detect if he's human. And then show him 2 unknown pictures, even if niggering, he will still solve 1 correct image.
