So I'm getting Linux for web browsing but I need a Windows OS for gaming. This may sound like a stupid question but if I were to get W10 would Microsoft still be able to invade my privacy even when I'm using Linux or would that just be for W10?

Theoretically, MS could include a driver for ext4 or whatever FS you're using on Ubuntu and see the files. To be completely sure, encrypt the Linux files.

Use two computers if you only use steam for gaming.
Buy an i5 laptop, throw gnu/Linux on it. Keep your win10 gaming rig somewhere else.
Use the steam streaming features to stream the games you want to play to your laptop.
If you have a wired network connection, you won't notice a difference.
