I think it's a bit more interesting than that.
If the customers sign up for up to 50Mpbs and they get 10, ISP is still holding their end of the deal.
But the customers have a 50Mpbs plan and Netflix only ever gives them 10, it looks like Netflix is doing badly, even if the problem is actually the ISP
