That's not what happened. Carmack in his official capacities at ZeniMax was developing VR software. He leaves ZeniMax and goes to work at Oculus who suddenly has a massive leap in VR capabilities. ZeniMax sues Oculus for non-literal copying of their programs, which is where it gets tricky. IP law with regards to software is a very tricky subject and is still not very mature. They always subpoena search records and emails because they always find gold nuggets there. They fund more useful data in there than on people's computers.

Programming doesn't give you intimate knowledge of how much information will remain in the filesystem structures about the old files. Sure anyone will know the file data is still there, but there might be more metadata left as well.
