Was it fully powered off when they took it? If it was, it isn't really possible for them to access it unless there's a literal backdoor. If it was on, they might do. It depends how much they care about its contents.

I own several Macs and none of them have a software client in them. It's an optional thing designed for businesses, so I don't think it activates unless you set it up. It's similar to the Intel ME or something like that.

Is it just FileVault 1 that could be unlocked with the Master Password, which could be reset by the install disc, which - even if you set a BIOS password to prevent booting from the non-default device - could just be reset by taking the CMOS battery out, thus rendering FileVault 1 essentially useless?
