If they decide they don't want us to ship the SSDs then we can start a change.org petition, send it to all the major news outlets, email their support demanding our SSDs.

Why would they do this. Many of us have made promises to our family member and friends of getting this for them as a gift, only to be left disappointed. We received no compensation, no coupons. The CEO is worth $20 billion dollars, but they don't want to provide what they promised to their customers. Most of the charge for the SSD is for marketing, R&D, etc. They can afford this. They sold $2000 laptops in mexico for just $30, a MUCH bigger discount. Another example of an American company being assholes to their customers. They probably will lose more money from this, as thousands of customers wont be purchasing dell products again. Not to mention many of us even received CONFIRMATION emails saying that we would be getting out products.

A while back when Razer was MUCH smaller they made a similar but much bigger mistake. They honored it unliked Dell.

We just have to stay persistent and we will get out SSDs.

it was not an obvious pricing error, it looked like a legitimate sale.
it was up for over 6 hours
some people got their orders fufilled apparently
they took everybody's money already
now they are trying to sell them 80 dollar ssds instead
that's textbook bait and switch and according to the FTC it's also illegal
>>

>>58351784
Bump,
>>
>>58354502
Bait and switch is when they try to upsell you. That's the "switch" and it's required for it to be bait and switch.
This is an advertising pricing error and companies are not bound to sell to you at that price. You're not going to get a $39,999.99 car for $.99 because somebody forgot to type in a few digits.
Laws are made to protect people from swindlers, not to enable them. In this case you're the one trying to swindle a product, so guess whose side the law isn't on?
>>
>>58351784
Confirmed, but not cancelled.

CC statement still lists it as a pending charge.
>>
>>58356157
they tried to upsell me on the phone when i called them. also their terms of service state that once they ship a product out the tile is transferred to the customer.
they are fraud intercepting packages that have already had the title legally transferred to their customers.
they are breaking their own terms of service
they are the ones that swindled us
they used our lines of credit for viral marketing
today there were articles about the new western digital ssds in several popular pc news sites.
the deal was up for at least 6 hours... that was not a mistake. they rode the wave of publicity so we have to ensure they get bad press for abusing their customers lines of credit.
>>
>>58357146
Offering you the item at the correct price is not "upselling," it's "selling."
A package does not legally belong to you until it's at your door.
Cry moar.

>>58352387
>Starting petitons
>Expecting them to work

>>58352465

https://www.ftc.gov/tips-advice/business-center/guidance/advertising-faqs-guide-small-business

What makes an advertisement deceptive?
According to the FTC's Deception Policy Statement, an ad is deceptive if it contains a statement - or omits information - that:

Is likely to mislead consumers acting reasonably under the circumstances; and
Is "material" - that is, important to a consumer's decision to buy or use the product.
What makes an advertisement unfair?
According to the Federal Trade Commission Act (link is external) and the FTC's Unfairness Policy Statement, an ad or business practice is unfair if:

it causes or is likely to cause substantial consumer injury which a consumer could not reasonably avoid; and
it is not outweighed by the benefit to consumers.

Bait and Switch
How does the FTC define "bait and switch" advertising?
It's illegal to advertise a product when the company has no intention of selling that item, but instead plans to sell a consumer something else, usually at a higher price. For more information, ask the FTC for its Guides Against Bait Advertising.

>has no intention of selling that item, but instead plans to sell a consumer something else, usually at a higher price

Internet Advertising
Is advertising on the Internet subject to the same laws as other advertising?
Yes. Ad claims on the Internet must be truthful and substantiated.
>>
>>58357519
You have to be 18 to use this website.
>>
>>58357513
in their terms of service you can enter arbitration with them, it's actually required you do that or take them to small claims court individually. BUT IN THE AGREEMENT IT SAYS THEY PAY THE COSTS LOL
so literally everyone that ordered this shit can take them into arbitration over it, ESPECIALLY those who had their orders fraud intercepted in transit.
>>
>>58357535
you probably work for dell damage control pajeet.
they're fudging ftc rules and their own ToS
>>
>>58357538
There's no terms of service here. They cancelled the order.
>>
>>58357570
by placing a purchase order you agree to the terms of sale according to them, otherwise none of the contract would be enforceable.
http://www.dell.com/learn/us/en/uscorp1/terms-of-sale-consumer
>>
>>58357538
They can do whatever the hell they want, they're not bound by their own TOS unless you force them to, and the way to do that is to sue them.
>>
>Orders, Pricing and Payments. Dell strives to communicate accurate pricing and product information but will not be held responsible for any pricing, typographical, or other errors in such communications. Your order is subject to cancellation by Dell, in Dell's sole discretion.

>Purchases may not be resold or exported. Your purchase is for your own use, not for resale or export. Your purchase may not be sold, leased, or transferred to restricted countries, restricted end users, or for restricted end uses according to U.S. export and sanctions laws.
>>
>>58357615
You agree to the limits they set. They do not have to go through and serve, though.
They bind you, not them.
>>
>>58357624
And you cant sue them because you agreed to a binding arbitration clause.
>>
>>58357624
>This is a binding agreement. As an Agreement between Dell and yourself, it may NOT be altered, supplemented or amended by any other document unless the new document is signed by both you and Dell. In addition to this document, the terms contained within the other Dell documents referenced in this Agreement, including Dell’s License Agreements, Return Policy, Consumer Service Contracts, and Consumer Warranties may apply to your purchase.
>not bound by their own TOS
riight... dell pajeet confirmed...

>>58357628
>Shipping. Product title passes to you when the Product is shipped.
if they give you a tracking number and then intercept the package they are stealing from you as they already legally gave you legal title, it says so right there in their terms of sale!
idk why they worded it that way it's pretty retarded on their part
>>
>>58357628
>Purchases may not be resold or exported. Your purchase is for your own use, not for resale or export. Your purchase may not be sold, leased, or transferred to restricted countries, restricted end users, or for restricted end uses according to U.S. export and sanctions laws.

that entire line is unenforceable, look up first sale doctrine. After it's you take ownership you can do whatever you want with it. Except shipping it to countries with sanctions.

Had a hell of a time explaining that to my bosses at a distribution company.
>>
>>58357684
also this lol just because their agreement "takes away freedoms from you" the freedoms are protected by laws paid for by taxes that usurp dell's legalese
>>
>>58357667
>riight... dell pajeet confirmed...
fuck you, i have one ordered i just lived long enough how shit like this goes down. we can't win, if they decide to cancel then its over, if they ship them then we all did good.

the facts are pretty simple they priced something for $20, they took the money and now they changed their minds. I seriously doubt even a paid for them arbitrator would have a hard time with this. you'd have to sue them, and that will cost more than the drive. there are no winners here.
>>
>>58357737
you don't need a lawyer or at least I don't dude this is pretty cut and dry, and they pay all the arbitrator fees in exchange for you agreeing to arbitration and waiving your rights to a class action
>>
>>58357624
>They can do whatever the hell they want, they're not bound by their own TOS unless you force them to, and the way to do that is to sue them.
Suing wouldn't work, since their TOS doesn't apply to them at all. It's an agreement by the customer to abide by their set of rules in order to qualify for service, not an agreement by themselves to abide by anyone else's set.

Customer: "I WANNA CANCEL MY ORDER! I DON'T WANT IT ANYMORE!"
Dell: "It's already shipped. The terms of this service don't go as far as us recalling an order once it's shipped, so no, we won't do this for you.

Customer: *makes purchase*
Dell: *ships purchase*
Dell: *notices pricing error, cancels order, and calls back shipment*
Customer: "UR VIOLATING UR TOS!"
No, they're cancelling your service and servicing themselves. It ain't against their internal TOS to call back a shipment.
>>
>>58357778
how old are you??
>>
>>58357684
>that entire line is unenforceable
It's not for contractual penalty, it's for refusal of service.
>>
>>58357783
yeah except for the part about product title transferring once an item ships. that's a BIG DEAL.
title is ownership, they're saying you own the item as soon as it ships right there in their terms of service
of all the stuff you agree to, that's what you're agreeing to it for, for ownership in exchange for purchase.
they say right there that YOU OWN IT once it ships, they can't legally take it back, you will win if you find out they intercepted your package.
>>
>>58357836
Once you buy something, no one can tell you what to do with it, no one can take away your ability to resell that same product, it is yours to do what you want with it, including resale or export.
>>
>>58357817

Entitled much? Kys fucking faggot
>>
>>58357841
>yeah except for the part about product title transferring once an item ships. that's a BIG DEAL
No it isn't. The terms of service bind you, not them. You cannot get out of the title as long as the terms are in effect. By cancelling the order they cancel the terms, so the title reverts to them.
>>
They haven't taken the money out of my account yet, so far they're only authorized it but not captured it, meaning it wouldn't cost them a thing to "not charge" me, has anyone had a full transaction done on their account as in completely taken out of the account and not in upcoming transactions?

Doesn't your country have some sort of national customer entity? At least where I live there's one, and it rules over any company in the country, regardless of any inside policies they may have. Every time there's a pricing error and people take advantage of it, companies end up being forced to deliver the goods to their customers at that price.

there's no bait, no switch. of course they weren't selling SSDs that retail for $80 for $20, that's an obvious pricing error.

I bought 10 drives on the off chance they did honor the deal, but of course they cancelled it.

Are you people really this dumb that you feel wronged? Buncha fakers and babies.

Deals happen

In this case the deal was just a bait

bait for what? I got my $250 back, never left my account actually.

They got nothing, I got nothing, it was a pricing error. I just think it's funny that people are going to pretend to be outraged and stir up social media shit to try and get some free nigger tech. Wew lads.

>The obsession with Samsung SSDs is bizarre.
They have arguably the best drives in terms or speed, longevity, ruggedness and risks of failure for certain series like the 850, rivalled only really by intel ssds.
