It's not.
The problem is if you feed the fair algorithm INaccurate data, you get biased results. So if you use a dataset with strong known biases, (such as conviction data by race), you get discrimination from machine learning algorithms. And if the biases of the people who built the system line up with the data the system is trained on, they're highly unlikely to notice (or care) that their system has actually gone off the rails.

If you treat convictions by race as committed crimes by race then the problem isn't that the data is inaccurate, it's that you are applying the data to something that it is not. I think that in this case, if you fed a dataset to a machine that was as close to or better than a real humans observation then it raises a few problems.

The first is that a "systematically wrong" answer is impossible to define if you claim the data put into the machine is correct. If the machine is logical and removes personal bias, how can one confirm that a machine has the correct outcome if it doesn't (or does) agree with our observation?

Likewise, if the answer is "close" but we perceive it as being wrong then can we say that the machine is inaccurate?

I think that in the theoretical situation of a fair machine, and with data obtained to the best of our ability as being accurate, the results cannot be thought of as inaccurate when talking about the observations of the machine. The data would be "real world" and not our observation, and the result should be real world.

The thing that I'm trying to say is, this isn't a problem of machine learning, or even a technology problem. Humans have more bias than any machine so matching observation with result, and ensuring fair data acquisition in the case of data processing, is a social problem.
