The users have a perfect freedom not to use either offering. It's the user's' sense of entitlement that makes them think they have the right to use proprietary software without paying.
The breakdown of any society model is when the people don't opt in to the rules. It shouldn't be necessary to enforce the rules, the people should see the value of following them.
If people can't see any value then the model doesn't work and no amount of enforcement can get more than a grudging compliance.
