Any OS or firmware developer has this ability.

Most likely what happened is during internal testing, Apple found that TB3 devices were causing serious issues when hooked up to Intel TB3 chipsets and blacklisted the offending TB3 controllers. The fact that they're blacklisted suggests that the way these devices misbehaved was serious, e.g. capable of causing serious damage and/or bricking.

Given the clusterfuck USB 3 has been I'm not surprised at all. It's something like 5 years since USB 3 devices hit the consumer marketplace and yet it's still damn near impossible to find powered USB 3 hubs that aren't flaky shit.

Apple made the right call because the old TI chipset had some issues. The minimum issue is that data could be corrupted, but the maximum issue is power (current draw) could damage the port on the MacBook. If we want to fault Apple, then we should ask - why is there no Apple certification program for TB3 over USB-C similar to MFi for lightning.
