Just got a fine from pic related because i downloaded, London has fallen last month. gonna wait to see if they go through (send me a warning that i have to pay the fine) before i actually do. whats your opinion on this /g/? do you think torrenting should be taken this serious? are fines like these ok? should monitoring of other peoples internet downloads and setting up filters be alright?
>>
Edit the fine is set to 1500KR or 170 dollars
>>
If its from a lawfirm instead of your isp I would call bullshit. ask them where they got their info. if they got it themselves then press charges.
or kys either works.

Are you... asking... /g/ for... legal advice?

Maybe you should not do that.
>>
>>57233312
I'm not, just telling what happend and trying to start a talk about online tracking

A law firm cannot fine you in any country i know of, they have to take you to court and the court fines you.

What they sent you is a threat to sue you if you do not just pay their client upfront

A few firms - almost always specialist firms - have taken this kind of thing up as a business model: threats to "settle" which may require you signing something to say that you did something wrong, and frequently wouldn't actually stop them suing you anyway.

It has not always been in favour, and has been - rightly - compared to extortion, for example in the matters involving ACS:Law and the solicitor Andrew Crossley here, who was a complete douchebag who threatened innocent grannies and fucked up the whole thing spectacularly, resulting in him receiving huge fines, his bankruptcy, being struck off, and a friend of mine now driving the smug git's previously-owned Lamborghini. Couldn't have happened to a nicer chap.

That is not usually how the story ends, but there do seem to have been comparable abuses in some of the similar cases in the US involving Prenda Law (et al) and alleged pornography downloading.

The quality of the 'forensic' evidence supporting it varies wildly, from "my printer was sent takedown letters because we registered its IP with a Bittorrent tracker"[1], to screenshots fabricated with scripting and imagemagick - to, sometimes, relatively strong proofs of IP address/time/verified chunks of known-infringing files which might, depending on your jurisdiction, constitute enough for a court to start searches, seizures, analysis and actual legal cases, depending largely on how fucked/unlucky one is.

Good, because we definitely couldn't advise you. You might want to have a word with somebody to get some advice about what you, specifically, ought to do, especially if you actually did download that thing.

a bit offtopic rant...

I've been following this and I can see as the pic related to OPs post that this is in full effect now in Denmark. Here in Sweden we have something called "Spridningskollen"(company behind it is called Gothia Law) and they try to fish some cash from people(and scare people) with letters demanding money.

They represent Hollywood companies and other related copyright companies so this is obviously a new tactic to counter piracy.

Funny thing about "Spridningskollen" is that a Swedish ISP company, Bahnof, has launched a site called exactly the same thing but with the .org-domain and then copyrighted the word "Spridningskoll" so they could send them a letter asking for cash for using "their" name. Bahnof likes to troll and be very vocal about things like privacy etc. Great PR from their side desu.

The discussion on Swedish sites are mostly people recommending that you dont pay and give them the middle finger when you get the letter. They won't bother dragging you to court and settle there. But I wouldnt give you this as a legal advice as I don't know how your country's(Denmark?) "debt collection" laws and agencies work.

Shakedown letter. Don't pay the fine, they can't do shit. They might send you another letter or two but it's all hot air.
