Is it ethical that governments spend tax money on non-free software?

Yes
The US government should use the best tools for the job within reason. I'm sure they get volume discounts on software anyway.
Since when does any government care about ethics and morals?
It's not really non-free when the government uses it. What's anyone going to do if the government violates an EULA, sue the government?
is it ethical that governments spend tax money on non-free prostitutes?
Is it ethical that the government spends tax money on importing third-world shitskins?

Yes
Let me pose an alternate question.
Is it ethical that governments use secret algorithms for things like voting and social security that effect the public directly?
I would argue it isn't, and that therefore any software the government uses should be open source. That doesn't mean it has to be free or non-proprietary, just open source.
Taxes are immoral in and of themselves

Look up our foreign aid program for a better understanding of how much tax money is wasted each year.
Theres even an interactive map showing the countries, its published by the gov so you know its legit.
Glad I could be of help :))

Violating the EULA doesn't give you access to the source code, and OF COURSE you can sue the government.
Governments have been successfully sued countless times.
