This is called "Full" telemetry, the level over and above the "Basic", "Standard" or "Enhanced" levels available in normal builds of Windows.

All Insider (beta) builds are locked to Full telemetry. All Insiders are aware of this and specifically agreed to it - it is why Microsoft are running the Insider programme, because it is how they are collecting the data on compatibility and usage that they are using for a large part of the feedback.

It cannot be selected in - in fact, is not even compiled into - release builds (checked or unchecked) of Windows 10.

This isn't to say I approve of this, but they were open about this from the very start of the Insider programme.
