Besides, even if it wasn't, I'm pretty sure Disney knows that a lawsuit against South Park would end up being a marketing disaster for Disney. Even if Disney would win it (and Disney would win it easily), South Park would still manage to make profits out of it somehow.
South Park can do anything they want, they make comedy central a fortune.

I think it's more like the intent of the jokes. In Drawn Together the joke is him as a shadowy mastermind, in South Park the joke is him as a skeezy piece of shit manager. Different jokes means different portrayals.
