All they did was cartoonify and exaggerate the already exaggerated Batman Returns design but give him short orange hair to make an allusion to rockhopper penguins.
He's not terrible like the other characters but he's not much to look at either.

Because it is is a poor design choice.
The garish orange hair is way too out of place compared to the rest of design. It's a fuzzy little clump of orange tacked into a design built entirely on monochrome elements because they thought they were being clever by making him look like a rockhopper penguin
Penguin's hair is not really an integral part of his character design so it usually fluctuates from either near-balding back hair to a round black circle on his head to the long and greasy Dr.Caligari haircut he was given in the movie, but it's never the point of focus.
Making it such a point of focus without changing the design is the kind of dumb decision a kid would make by mistake on a coloring book.

It could have worked if his design was more similar to Silver Age Penguin, who was more tacky and colorful, or if they had given his clothes other colors than black and grey. They could have given him the purple top hat of Burgess Meredith.
Like I said, it's not the worst design of the show, I'd say it's actually one of the more salvageable ones. But that really doesn't make it good..

The issue is the tophat. Without the hat it'd look find, but with that it looks like fringe. I'd say a bigger issue was the lack of contrast in the colors. He's primarily black with two shades of grey and they use one of those shades for both clothing and highlights.
