At this point, probably.
They have had some missteps, but no outright critical failures, or box office bombs. It's unheard of for a studio to be putting out so many back-to-back hits without one of them being considered terrible.
At this point, Marvel has earned a chance to create something with a new character.

Yes. Because Marvel has shown to be able to make movies based on characters that are not extremely mainstream but still are successes (Ant Man, Guardians, Doctor Strange), while Sony can't make a successful movie with one of the most popular characters in the world.
