It sounds like Del Toro is intentionally treating Abe as a public domain monster. Abe himself isn't public domain of course, but a merman isn't technically new.

I guess you can treat this film like you would all those Dracula movies that are independent of each other. That yes, it is about a telepathic fishman, but Lovecraft did write about them long ago and Lovecraft's fishmen ARE public domain.

It is easier to legally defend yourself if you say you are basing your main character on a known public domain creation. Then you don't have to prove your character is close enough to mythology.
