If you do original work containing someone else's copyrighted character then you own the work but not the character. You can't profit without the original characters owners permission and they can't profit from your work because they dont own it even if your original character is featured in it.

So he definitely has a case not that it matters. US copyright law goes in favor of who ever has the most money and lawyers.

Honestly, I've never heard of this guy before, I just saw the thumbnail and the OP and got intrigued. But after seeing why he's allegedly mad, I can't help but wonder if this is a chicken or the egg type thing. Jerry Robinson designed a character so iconic precisely BECAUSE the physiognomy is bizarrely exaggerated and beyond most humans. An actor comes along with the perfect face/build plus the necessary Carrey-tier flexible skin/musculature, who researched everything EXCEPT DC's never-changing position on public drama with creatives (i.e. death sentence).

If Joker were a Marvel character, Marvel would have hired him to write a (terrible) Joker miniseries for quick promotional bucks. Of course if it turned out that he had an actual talent for writing, he'd be like Way where people would eventually forget he had a career before writing comic books (plus the eventual weight gain would lessen the resemblance).
