A lot of bits are getting debooted, actually. It's more of a gradual deboot to how the DCU was Pre-Flashpoint, both on an aesthetic scale, and as you mentioned a historical sense with the legacies.
Shazam's been hinted at getting debooted, with the appearance of his old outfit. Characters' old Pre-Flashpoint costumes are getting brought back into history, as opposed to Jim Lee's redesigns.

It won't be 100% like how it was before New 52, but overall I think it'll be more like a mix of the good parts of the New 52 with the old DC Universe. Which is exactly what Johns was talking about, saying it would seat the New 52 in previous continuity.

I'm not sure. We see Wally's first Kid Flash costume in the DC Rebirth, unchanged and without the Jim Lee lines or chinstrap. And Barry's old costume was in a splash page on Rogues Reloaded, though I'm not sure how canon that is.

Superman in his bright blue spandex and trunks at the center of this image would be really out of place, though. I can't really see Superman, Doctor Fate, and Hawkman being the only guys with their Pre-Flashpoint looks.

I think whatever's going on with Rebirth, we'd have to wait until the end of Doomsday Clock, or if that starts an event, the end of that event.

Supermans creators lawsuit is why nu52 happened. Warner won when the judges agreed the superman creators terminated their rights to get them back. All they own is early superman adventures.

Warner also won for SuperBoy.

Carmine Flash suit is more tricky, he did not work for hires flash costume but did for everything else. Deviations like wallys or even the smaller one don't count. So dc owns them for new material.

As for Neal Adams Batman costume, that's more about fees that only retro product service can afford to give. They can use the carmine one for batman as shown in dc rebirth previews.

Most old costumes are being restored anyways. Ted Kords blue beetle suit, the creeper back in his costume.
