The school is modeled after a real one in NY. It runs on donations and is really prestigious but enrollment is entirely random. You can't buy your way in. They produce the best students in the country and really pride themselves on giving kids of all economic backgrounds equal education, external circumstances from wealth cause a heavy correlation with school success and I believe the school founders specifically wanted to address that.

Tangent: They basically fixed it by getting rid of summer break, and having 12 hour school days (clubs, homework, etc), so that all of your time is spent with school. They found that poor students learn at the same rate as rich students, but during summer break and other free time the wealthy keep learning and pull ahead while the poor stagnate until school begins again. The large amount of hours put in is also why the have such hard marks. Math, for example, has been proven to correlate almost EXACTLY with amount of hours spent studying. People being held in Guantanamo are being held with due process, without getting a trial, but if any of them escaped they'd damn well be called criminals (probably war criminals) and hunted down. The government does shady shit to get around its own laws all the time, and then it words stuff in just the right way so that the average citizen doesn't think too hard about it.

If cap can kill people and brake into other countries, if they can smuggle weapons into any country they want, then the hydra soldiers are assumed innocent until there's a trial.

A difference is that Steve rogers and his team DID commit everything they are acused off, while the hydra soldier that was killed was just "planning" to do it.

The only Hydra soldiers who we know were killed died when their own bomb blew up.

Steve and his team didn't engage them in combat until after the Hydra terrorists had already attacked the Infectious Disease Center, and had already shot to death quite a few local soldiers and civilians.

Of course, any captured Hydra men need to be tried and convicted, not just summarily executed - or locked away in a non-jurisdictional prison.
