You do know that Return to Oz was based on two Oz novels (that are in the public domain), right? The Nome King came from the third book. They can't use Disney's version of the Nome King but they sure as hell can do their own take on the character. Disney meanwhile couldn't base their designs on the MGM film, but this cartoon can since they were already using the MGM film as a basis to begin with. Disney did however have to pay MGM a fee for using the Ruby Slippers since in the public domain books, the slippers were Silver.

The Oz books going into PD had more to do with the copyright law changes. Disney's Return to Oz wasn't out till 1985 but Ozma of Oz was PD in 1983 and Dorothy And The Wizard of Oz was PD in 1984. The first two books, Wizard of Oz and Land of Oz, were PD in 1956 and 1960 respectively. It could be argued that Disney's Return to Oz flopping at the box office probably made it easier for the books to go PD in the past decades and the last Baum Oz book went PD in 1996.
