That $2.99 issue was the hook: it was the "We're really gonna do this, here's a great deal, get onboard" backing up of the words being said. DC literally put their money where their mouth is.

Marvel pricing this at $5.99 says "Legacy is going be the best selling comic in September and that's gonna be GREAT for our margins. Maybe we can do it again in 6 months!" Not to mention the total lack of creative mix-up or realignment, barring Rainbow Rowell on Runaways - and bringing in a novel writer for a relaunch is something Marvel does practically every month.

Either Marvel has the rights and has plans to use him at some point (which would explain why they're using him so much) or Fox has the rights and Marvel is pitting him against non-X characters to make it hard for them to use any new storylines.

Also i just recently read the Red Hood and the Outlaws Rebirth first arc, which I was pleasantly surprised by, and unless I am mistaken this seems to be post-crisis Jason and not New 52 Jason. I dropped the first volume of RHATO pretty early but I remember them changing his origin and him stealing drugs instead of tires from the Batmobile but in Rebirth it went back to his order original encounter with Batman.

I would be inclined to agree, but with the exception of the cast of X-Men Blue, they haven't suffered the same fate as most of the main Marvel cast of core heroes, being gradually replaced by younger, less-interesting counterparts. That's what Legacy seems to be addressing. Including the X-Men would be like administering a cure to a patient not suffering from the disease in question.
