That's actually not even 100% certain in the movies.
Stark is originally trying to copy an already-functioning AI that's in the mindstone. The flashback of Tony saying "Peace in our time" during Ultron's conversation with J.A.R.V.I.S looks like it's from the Sceptre's perspective. The AI holographic representation that attacks J.A.R.V.I.S is the same one that was shown for the AI in the mindstone, no third "new" AI is ever shown. Ultron immediately asks where his body is, and there were Ultron bodies in Strucker's Hydra facility before Tony even got the Sceptre. Tony insists that they made no progress in trying to copy the AI. Thor even explicitly says that Ultron came from the stone. All they'd have to do to handwave it back to Pym is have a throwaway line about Pym trapping an AI he created in an alien weapon back in the '80s.

That's pretty much what it seems like. I don't know how many casuals will buy it but I don't think most fighting game players will care much about this. Capcom has a lot of bad publicity because of SFV. The Marvel VS games are popular but there's not a lot of hype for this game like there was for MvC3 for various reasons.

People just don't realize that the public doesn't care for fighting games in general, Injustice only sold because DCfags only care about the "story" while its largely ignored by fighting game fags because the combat isn't good, despite all the hype its getting now Dragonball Fighter Z is only going to appeal to weebs and even among them they're going to shit on it for not being Tenkaichi 3 again or for not having customization ala Xenoverse despite it already looking and playing better than both already and since its an anime fighter its going to get scuffed by the FGC From what I've seen thus far MvC:I plays just fine its just that the presentation is just fucking terrible, like so many back when MvC3 was announced I hated the switch to 3D but they really tried to still retain the comic book aesthetics to give it a style so the presentation stood out and I grew to appreciate it but in MvC:I they did not try at all.
